1. Motion for Live Telecast

Counsel for the Petitioner sought to move their application for live telecast of proceedings. The Court however halted him in his tracks and said the request was moot since the court on its own had taken the decision to telecast the proceedings. Indeed, there were cameras already in the court from GBC. The motion was therefore struck out as withdrawn.

2. Motion to amend/correct errors by Petitioner

Counsel for the Electoral Commissioner and Counsel for Nana Akufo-Addo opposed the application to the extent that the petitioner was seeking to amend paragraphs in a writ when what was before the court was a petition.

The Court, per Nene Amegatcher JSC., asked Counsel for the 2nd Respondent whether he had made a mistake before to which he responded Yes. The learned Judge then stated “All of us make mistakes” to wit, mistakes are part of human every endeavours.

Counsel for the 2nd Respondent then stated it is for the same reason the petitioner should have been more kind to the Electoral Commission on its innocuous mistake rather than take out the present petition.

The Court per the Chief Justice also stated that the petitioners were entitled to amend even their amended petition should the need arise. Thus an amendment could be done as many times as necessary.

After a brief recess, the court ruled granting the Petitioner’s motion for amendment on the basis that the proposed amendment did not affect the substance of the petition.

Petitioner was ordered to file the amended petition by 4pm today for the Respondent to respond by Friday, 15th January, 2021

Case was adjourned for Pre-trial conference on Tuesday, 19th January, 2021.
